Huggle Terms and Conditions

Huggle is a location-focused platform enabling you to discover and connect with people who go to the places you go!

Have you ever wanted to talk to someone in your favourite cocktail bar or the person working out next to you in the gym?! Well on Huggle, you can! The Huggle website (Website) and mobile application (App) uses clever geolocation technology to make this happen.

In order to enjoy these services you will need to accept our rules and guidelines. These Terms and Conditions of Use (Terms) and our Privacy Policy apply to your use of Huggle's services and shall be governed by English law. The terms are a binding legal agreement between you as a user (you) and us, Huggle. By accessing, using, registering for or receiving services offered on Huggle (Services) you are accepting and agreeing to be bound by the Terms.


Key Huggle facts

  • You must be at least 18 years old to use Huggle.
  • Huggle records your location in order to determine your proximity to other users. Please read our Privacy Policy for more details.
  • Huggle is not responsible for anything you post or say when you are using our App. Before using Huggle, you must be prepared to take responsibility for all of your content!

Eligibility to join Huggle

To take advantage of Huggle and join, we need you to confirm a few things. By using Huggle, you represent and warrant that:

  1. you have the right, authority and capacity to enter into and be bound by the Terms;
  2. you will not be violating any law or regulation of the country in which you are resident;
  3. you are solely responsible for your compliance with all applicable local laws and regulations; and
  4. you have never been convicted of a felony and/or are not required to register as a sex offender with any government entity nor are subject to any court order relating to assault, violence, sexual misconduct or harassment.

Content - who does it belong to?

Your content

You can post all sorts of things to the Website and/or App, such as:

  • text;
  • graphics;
  • images;
  • music;
  • software;
  • audio video;
  • works of authorship of any kind; and
  • information or other materials that are posted on the Website/App (Content).

When you upload Content to Huggle it can be accessed and viewed by the general public.

Any Content posted or shared is the sole responsibility of the poster - so only post Content if you are happy to take responsibility for it!

Once your Content has been posted you grant us a non-exclusive, royalty free, perpetual, worldwide licence to use Content in any way (including, without limitation, editing, copying, modifying, adapting, translating, reformatting, creating derivative works from, incorporating into other works, advertising, distributing and otherwise making available to the general public such Content, whether in whole or in part and in any format or medium currently known or developed in the future).We also reserve the right to assign and/or sub licence the above licence to our affiliates and successors without any further approval by you.

You must only upload your own Content, and by submitting Content to Huggle you represent and warrant that you are the owner of such Content and the provision of such content on Huggle will not infringe, misappropriate or violate a third party's intellectual property rights, rights of publicity or privacy, or any other rights or result in the violation of any applicable law or regulation. If you break the rules, we have the right to disclose your identity to any law enforcement agency or any third party who claims that any Content posted or uploaded by you to the Website or App constitutes a violation of their intellectual property rights or of their right to privacy or any other law. We are not obligated to review/edit content or monitor access to the app. However we have the right to remove or edit content at any time and without prior notice if we, in our sole discretion consider any Content to be contrary to these terms or any applicable law.

You must not share your Huggle password with anyone else or let any third parties access your account - if you suspect someone has gained access to your account, you must contact us immediately and change your password. Huggle is not liable for any unauthorised access to your account. Huggle reserves the right to terminate your account if you violate these rules.

Huggle content

All other graphics, user interfaces, trademarks, patents, logos, sounds and artwork on Huggle are owned, controlled or licensed by us and are protected by copyright, trademark, patent and other intellectual property law rights (Huggle Content) - we're proud of our creation!

You do not have any rights in Huggle Content. You may not copy, modify, adapt, distribute, publish or sell all or any part of the Huggle Content because that wouldn't be fair.

Data protection

We collect some of your personal data when you join Huggle, which we process in accordance with these Terms and our Privacy Policy. By using Huggle you agree to such processing and warrant that all data provided by you is yours and yours alone.

Acceptable use

Please think carefully before you post or send any Content. We do not permit any Content which is obscene, pornographic or otherwise may offend human dignity; or shows another person which was created or distributed without that person's consent.

Here are some other rules - all Hugglers must abide by these! You must not post any Content which is abusive, insulting or threatening, or which promotes or encourages racism, sexism, hatred or bigotry; or encourages any illegal activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offence; or contains expletives or language which could be deemed offensive or is likely to harass, upset, embarrass, alarm or annoy any other person.

Please do not submit any Content which is defamatory; or itself, or the posting of which, infringes any third party's rights (including, without limitation, intellectual property rights and privacy rights); or relates to commercial activities (including, without limitation: competitions; sales; advertising; links to other websites and/or premium line telephone numbers).

We do not want any Content that contains any spy ware, adware, viruses, corrupt files, worm programmes or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, Trojan horse or any other material designed to damage, interfere with, wrongly intercept or expropriate any data or personal information whether from Huggle or otherwise; or involves the transmission of "junk" mail or "spam".

Please remember you are solely responsible for and bear all liability for such content, so think carefully before posting anything.

You may only use other Huggler's personal information for the purpose of connecting and meeting each other. You may not use other users' information for commercial purposes, to spam, to harass, or to make unlawful threats. Huggle reserves the right to terminate your account if you misuse other users' information.

Deleting your account

We don't think you'll ever want to leave Huggle, but if you do, you can terminate your account at any time by going to the ‘Settings' control on Huggle when you are logged in and choosing the ‘delete profile' link. Just in case you change your mind, we will save your profile information for 30 days - during which time you can reactivate your account if you want. When you delete your account, we have the right to delete any Content that you have submitted or uploaded on to Huggle. Please refer to our Privacy Policy.

If you breach these Terms or act in a way that is not consistent with the purpose of Huggle, we reserve the right at our sole discretion, at any time and without liability or the need to give you prior notice or to refund any unused services to:

  • terminate your account and revoke your right to access and/or use Huggle or submit any content to Huggle;
  • suspend your account and right to access and/or use Huggle or submit any content to Huggle, until we, in our sole discretion, decide to either reinstate your account or terminate it; and
  • use any means available to us (whether technological, legal or otherwise) to enforce our Terms - this includes without limitation blocking specific IP addresses.

We will try (but we are not obliged) to notify you if your access to Huggle and/or your profile is to be or has been suspended or terminated. Content that you have uploaded to Huggle, other than your profile (such as comments or chat), may still appear on Huggle following termination of your registration.


Please note only registered Huggle users can access all of the Huggle services. If you are not registered: you will only be able to access the publicly available areas of Huggle; you will not have a Huggle profile; and you will not be able to upload any Content. If you are a registered Huggler, your access to Huggle may depend on certain criteria relating to your profile - we can change or update this criteria from time to time without prior notice and at our discretion.

Huggle reserves the right to suspend, withdraw, amend, modify or vary the service provided on Huggle without notice and without incurring any liability to you.

Huggle is provided on an "as is" basis - no warranty is given about the availability, performance, accuracy, quality or functionality of Huggle. We can't promise that Huggle will always be up and running as sometimes we need to perform maintenance to the site, or there may be a fault or other situation beyond our control.

If you want to access Huggle, you are solely responsible for making all the necessary arrangements, including Internet provider and mobile internet provider fees and any other charges associated with such access. If you do access Huggle through a mobile device, Huggle is not responsible for any reduced functionality you may encounter as a result of or in connection with the mobile services you use, or any similar service currently known or developed in the future. Also, you acknowledge and accept that you may incur charges from your internet or mobile service provider by accessing Huggle or agreeing to receive messages or notifications from Huggle. We shall not under any circumstances be liable for such charges.


Warranty disclaimer: The services and content are provided "as is" without warranty of any kind whether express or implied. Use of Huggle and the materials available on it is at your sole risk. Huggle cannot be held responsible for any loss arising from the transmission, use of data, or inaccurate Content posted by users. You are responsible for taking all necessary precautions to ensure that any material you may obtain from Huggle is free of viruses or other harmful components. You accept that Huggle will not be provided uninterrupted or error free, that defects may not be corrected or that Huggle, or the server that makes it available, are free of viruses or bugs, spyware, Trojan horses or any similar malicious software. Huggle is not responsible for any damage to your computer hardware, computer software, or other equipment or technology including, but without limitation damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure or any other technical or other malfunction.

Limitation of liability: PLEASE BE SENSIBLE WHEN PICKING THE CONTENT THAT YOU CHOOSE TO POST ON OR SEND VIA HUGGLE BECAUSE YOU ARE SOLELY RESPONSIBLE FOR AND BEAR ALL LIABILITY IN RELATION TO SUCH CONTENT. In no event shall Huggle be responsible for any liability incurred by you from use of Huggle, its services or these terms and conditions. This exclusion of liability includes, without limitation, any claims, charges, demands, damages, liabilities, losses or expenses of whatever nature and howsoever direct, indirect, incidental, special, exemplary, punitive or consequential damages (however arising including negligence), loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, wasted management or office time, breach of contract or claims of third parties or other losses of any kind or character. These exclusions apply even if Huggle has been advised of the possibility of any such damages or losses.

This limitation on liability above applies to, but is not limited to, unauthorized access, theft, bodily injury, property damage, operator errors, strikes or other labour problems or any act of god in connection with Huggle including, without limitation, any liability for loss of revenue or income, loss of profits or contracts, loss of business, loss of anticipated savings, loss of goodwill, loss of data, wasted management or office time, the transmission of any disabling device or virus that may infect your equipment, failure or mechanical or electrical equipment or communication lines, telephone or other interconnect problems (e.g., you cannot access your internet service provider), and any other loss or damage of any kind, however arising and whether caused by tort (including, but not limited to, negligence), breach of contract or otherwise, even if foreseeable whether arising directly or indirectly.

Indemnity: As we have explained above – you are solely responsible for the content you post. You agree to hold harmless and indemnify us and our officers, directors, employees, agents, representatives and licensors from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable solicitor's fees) suffered or reasonably incurred by us arising as a result of, or in connection with, your access to and use of Huggle, the uploading or submission of Content to Huggle by you or your conduct, other than in accordance with the Terms or any applicable law or regulation (Claim). Huggle retains the exclusive right to settle, compromise and pay any and all Claims or causes of action which are brought against us without your prior consent.

Modifications: We reserve the right to suspend, withdraw, amend, modify or vary the service provided on Huggle without notice and without incurring any liability to you. Please remember it is your responsibility to check these Terms of Use from time to time for any changes. Your use after any change will serve as your acceptance of any changes, so if you do not accept any changes, you should stop using Huggle immediately.

Other Legal notices: If any of the Terms are declared to be illegal, invalid or otherwise unenforceable by a court of a competent jurisdiction, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms. The rest of the Terms shall survive, remain in full force and effect and continue to be binding and enforceable. Nothing in the Terms shall confer or purport to confer on any other third party, any benefit or the right to enforce any term of the Terms and the Contracts (Rights of Third Parties) Act 1999 shall not apply to the Terms. The Terms set out the entire agreement and understanding between us and you in relation to your use of Huggle and supersedes all previous agreements, representations and arrangements between us (either oral or written). Nothing in this clause shall limit or exclude any liability for fraudulent misrepresentation. No failure or delay by us in exercising any right, power or privilege under the Terms shall operate as a waiver of such right or acceptance of any variation of the Terms and nor shall any single or partial exercise by either party of any right, power or privilege preclude any further exercise of that right or the exercise of any other right, power or privilege.
